Beta honesty: these terms are a founder-written draft in the spirit we intend to operate. They get counsel review before open signup, and material changes will require re-acceptance.

The short version

You own your work.

Everything you make stays yours. You give us only the license needed to host and show it — and it ends when you delete.

The split is the split.

Creators keep 95% of tips, 88% of music sales, and 85% of PPV unlocks before payment processing. Creator memberships come later at 90/10.

Hearing is free; earning is verified.

Anyone can publish. Making money requires identity verification and owning what you sell. Reach is earned, never bought.

We moderate with a ledger, not a mood.

Enforcement follows written rules, gets logged immutably, and can be appealed. Bans have named states and real definitions.

You can leave, completely.

Delete your account and your content goes with it. Financial records are retained only as law requires.

The short version helps you read; the numbered sections below are the agreement.

1. Who can use CULTURE

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use CULTURE. You must be at least 18, or have permission from a parent or legal guardian, to buy, sell, or receive payouts.

You may be required to hold an invite during closed beta. One person, one account, real identity behind it — pseudonymous handles are welcome; fake people are not.

If you use CULTURE on behalf of a business or brand, you confirm you have authority to bind that entity to these terms, and partner-specific terms may also apply.

2. Your content and your license to us

You retain full ownership of the content you create, upload, or share — music, video, images, text, live streams, all of it.

So we can run the platform, you grant CULTURE a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transcode, display, distribute, and create technical adaptations of your content (thumbnails, previews, stream renditions) solely to operate, improve, and promote the service consistent with your settings. This license ends when you delete the content or your account, except for content already shared by others (reposts) and copies kept briefly in backups or as law requires.

We never sell your content, and appearing in ads requires your explicit opt-in. Undisclosed AI-generated content is ineligible for monetization; disclosed AI content is labeled.

3. The economics

CULTURE's standard platform fees are 5% on tips, 12% on music buy-to-own sales, and 15% on PPV unlocks. Payment processing is separate and disclosed at checkout. Creator memberships are not available at launch; when introduced, the planned platform fee is 10%.

Money follows completed purchases and tips, not raw engagement counters. Synthetic engagement (bots, farms, self-dealing) creates no payment entitlement and risks account termination.

Selling or receiving payouts requires completing identity verification (KYC) through our payment partners. Creator payments move through Stripe Checkout and Connect; CULTURE does not provide a stored-value wallet. Stripe or CULTURE may hold or reverse funds where fraud, chargebacks, or legal obligations require it.

4. Commerce, orders, and the shop

CULTURE is the seller for CULTURE-branded merchandise. A creator marketplace may be introduced later under separate seller terms; approved brand partnerships follow their written commercial terms.

Sellers must ship what they list, honestly described, with real inventory. Stock counts are live and never faked. Buyers get a report channel on every order; unresolved physical orders without tracking may be refunded per our buyer protection windows.

Digital purchases (PPV unlocks and downloads) are delivered after payment confirmation and are generally non-refundable once accessed, except where required by law or where the content was materially misdescribed.

5. What you can't do

No illegal content or conduct. No CSAM (zero tolerance, reported to authorities). No doxxing, credible threats, or targeted harassment campaigns. No nudity or sexually explicit content. No spam, scraping without permission, engagement manipulation, or circumventing rate limits, bans, or technical protections.

No uploading content you don't have rights to monetize. Covers and remixes may be hosted where law permits but cannot be monetized until licensing is in place.

No misusing reporting or appeals channels with fraudulent or duplicative claims.

6. Moderation and enforcement

Enforcement actions include content removal, visibility limits, monetization removal, and account states: shadow ban (your content is visible only to you), soft ban (you can't create new content), and hard ban (your content is hidden and access ends).

Every enforcement action is recorded in an immutable audit log with a reason code. You can appeal any account-level action; appeals are reviewed by a human and reversals restore what was removed.

We may suspend or terminate accounts that violate these terms, create legal exposure for us, or remain inactive for an extended period — with notice where practicable, and an appeal path always.

7. Copyright and DMCA

We respond to valid copyright takedown notices under the DMCA. Send notices to contact@cultureapp.gg with the work identified, the infringing URL, your contact information, a good-faith statement, and your signature.

Counter-notices follow the DMCA process. Repeat infringers lose their accounts. We may run automated rights checks and hold flagged content for review, but those checks do not replace your rights attestation or the DMCA process.

8. Your account and security

Keep your credentials secure; you're responsible for activity on your account. We support account recovery and device revocation from your settings, and we'll notify you of important account events by email.

We may reclaim handles that impersonate others, squat trademarks, or sit on prolonged-inactive accounts, with notice where practicable.

9. Leaving, deletion, and survival

You can stop using CULTURE and delete your account at any time from Settings. Deletion removes your content from the platform, except reposts by others, backup copies for a limited window, and records we must keep (financial ledgers, safety records) under law.

Sections about content licenses already exercised, payments owed, disclaimers, and disputes survive account termination.

10. Disclaimers

CULTURE is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. During beta, features may change, break, or be reset — we'll be honest about it when they do.

You may encounter content you find objectionable; account-level filters exist, and reports are reviewed, but we can't pre-screen everything.

11. Limitation of liability

To the maximum extent permitted by law, CULTURE and its officers, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill.

Our aggregate liability for all claims relating to the service is limited to the greater of one hundred U.S. dollars ($100) or the amounts you paid us in the twelve months before the claim.

12. Disputes

Before formal proceedings, you agree to try to resolve disputes informally by contacting contact@cultureapp.gg — most issues resolve fastest this way, and our order and moderation records are visible to both sides by design.

These terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Florida, except where your local law provides otherwise. [Beta note: arbitration and class-action provisions are deliberately absent pending counsel review.]

13. Changes to these terms

When we materially change these terms, we'll bump the version date, notify you in-app or by email, and ask you to accept again before continuing. The current version is always at /terms.

If any provision is unenforceable, the rest stands. These terms plus the policies they reference are the whole agreement between you and CULTURE, Inc.
